These Terms of Service ("Terms") are a binding agreement between you and SUNG, Inc. ("SUNG", "we", "us"), the operator of the Sung app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Community Guidelines, which are part of these Terms. If you do not agree, do not use the Service.
Our Privacy Policy explains how we handle your information. Please read it — by using the Service you acknowledge that your information will be handled as it describes.
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf.
You must provide your real date of birth at sign-up. You may not use the Service if we have previously banned your account, or if you are barred from using it under applicable law.
You are responsible for your account and everything that happens on it. Keep your password secure, give us accurate information, and tell us promptly if you believe your account has been compromised.
Your username is a public display surface. We may reclaim or require you to change a username that violates these Terms or the rights of others.
You own the content you create on Sung — your posts, photos, videos, stories, comments, messages, and workout proof submissions ("Content").
So that we can operate the Service, you grant SUNG a non-exclusive, royalty-free, worldwide, transferable, sublicensable license to host, store, reproduce, display, distribute, and adapt (for example, transcode or thumbnail) your Content, solely for operating, developing, and improving the Service. This license ends when you delete your Content or your account, except: (a) where others have already shared or interacted with it in ways that persist (for example, messages you sent remain visible to their recipients), (b) settled leaderboard records, which are retained as anonymized competition history, and (c) where we must retain it for legal, safety, or moderation reasons.
You are responsible for your Content. You represent that you have all rights needed to post it and that it does not violate the law or the rights of anyone else — including the privacy rights of people who appear in your videos.
We may remove or restrict Content that violates these Terms, our Community Guidelines, or the law, and we may preserve evidence of violations.
Sung is built around community-verified performance. When you submit a workout proof to a leaderboard, your proof video and claimed result are shown to other users, who review and vote on them. By submitting a proof, you agree to this community review.
Bodyweight verification is different: weigh-in videos are reviewed privately by our staff only and are never shown to other users.
Ranks, scores, streaks, badges, and other progression features are features of the Service, not property. We may adjust, recalculate, or remove them at any time — including to correct errors, respond to cheating or manipulation, or change how the Service works. Moderation and verification decisions (including admin review outcomes) are final.
Do not submit faked, doctored, or misattributed proofs. Doing so is a violation of these Terms and can lead to removal of results and loss of your account.
Sung is a social and competitive platform, not a source of medical or training advice. Nothing on the Service — including other users’ lifts, rankings, movement descriptions, or verification criteria — is instruction, coaching, or a recommendation that any exercise is appropriate for you.
EXERCISE, ESPECIALLY MAXIMAL-EFFORT LIFTING, CARRIES INHERENT RISK OF SERIOUS INJURY OR DEATH. CONSULT A PHYSICIAN BEFORE BEGINNING ANY EXERCISE PROGRAM. USE APPROPRIATE EQUIPMENT, PREPARATION, AND SUPERVISION (SUCH AS SPOTTERS) FOR YOUR ABILITY LEVEL. YOU ASSUME ALL RISK ARISING FROM YOUR TRAINING AND FROM ANY ATTEMPT TO MATCH RESULTS YOU SEE ON THE SERVICE.
Never let a leaderboard tempt you into an attempt you are not prepared for.
You may not use the Service to break the law or to harm others. Without limiting the Community Guidelines, you agree not to:
• harass, threaten, defame, or discriminate against anyone, or post hateful content;
• post nudity, sexually explicit content, or graphic violence;
• submit false, faked, or manipulated workout proofs, or manipulate votes, ranks, or leaderboards;
• impersonate any person, or create accounts by automated means or for the purpose of evading a ban or restriction;
• film or publish footage of other people in ways that violate their privacy or your gym’s rules;
• spam, scrape, harvest data, reverse engineer, probe, or interfere with the Service or its security;
• upload malware or content you do not have the right to share, including copyrighted music or media.
We use a combination of automated systems and human review to detect content that violates these Terms, and we provide in-app tools to report content and block users. We may remove content, restrict features, suspend, or permanently ban accounts for violations — with severity matched to the conduct, up to immediate permanent removal for severe violations. We may also block re-registration by banned users.

We respect intellectual property and expect you to as well. If you believe content on the Service infringes your copyright, send a notice satisfying 17 U.S.C. § 512(c)(3) to our designated agent at support@gym-social.com with the subject "DMCA Notice". We respond to valid notices by removing or disabling access to the material, we accept counter-notices as provided by law, and we terminate the accounts of repeat infringers.
The Service itself — including its software, design, branding, and content we create — belongs to SUNG or its licensors. These Terms do not grant you any right to use our name, logo, or branding. If you send us feedback or suggestions, we may use them without obligation to you.
The Service may link to or interoperate with third-party services (for example, gym locations sourced from OpenStreetMap, or screenshots you import from running apps). Those services are not ours and we are not responsible for them.
You may stop using the Service at any time and may delete your account in the app (Settings → Delete Account). Deletion permanently anonymizes your profile as described in the Privacy Policy.
We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including licenses that persist per Section 4, disclaimers, limitations of liability, and dispute terms) survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT CONTENT (INCLUDING COMMUNITY-VERIFIED RESULTS) IS ACCURATE, OR THAT DATA WILL NOT BE LOST.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PHYSICAL INJURY ARISING FROM YOUR USE OF THE SERVICE OR YOUR EXERCISE ACTIVITY, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
To the extent permitted by law, you agree to indemnify and hold SUNG harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your Content, your use of the Service, or your violation of these Terms or of anyone else’s rights.
These Terms are between you and SUNG, not with Apple Inc. or Google LLC. Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with the applicable app store’s terms of service when using the app.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.
Before filing a claim, you agree to first contact us at support@gym-social.com and give us 30 days to try to resolve the dispute informally.
We may update these Terms as the Service evolves. If a change is material, we will notify you in the app or by email before it takes effect, and continuing to use the Service after that date means you accept the updated Terms. The "Last updated" date above always reflects the current version.
